PURPOSE:
This position manages the workflow stream and administration of the entire legal function within the cluster in close liaison with external counsels and other internal departments such as DLD (Distribution Legal Department), Legal Affairs team, Regulatory team etcetera. These responsibilities are carried out WITH the objective to ensure cluster’s legal matters are managed properly, efficiently and that the relevant and respective stakeholders are shared and given proper advice & guidance and handle legal correspondence WITHIN the limits of organizational policies and SOPs, departmental objectives, business code of conduct and directions/guidelines from supervisor.
JOB SPECIFICATION:
Education and Relevant Experience : LLB and Masters in Business Administration preferred with 5 – 7 years’ relevant experience (Consumer Litigation / Utility Court Experience)
JOB DESCRIPTION:
1 Managing Legal and Litigation Matters:
Pursues cluster’s consumer cases which require legal and litigation involvement
Advises IBCs and other departments in cluster office on their day-to-day queries and legally assists them in all matters requiring dispute resolution
Provides legal and litigation support to the cluster head on priority matters
Studies consumer history thoroughly and prepares cases to be filed at relevant forum as per SOP
Coordinates and manages Legal Affairs arising out of billing disputes
Meets targets pertaining to recovery from litigation
Escalates theft and related consumer’s misconduct at appropriate legal/law enforcement levels including registration of FIRs where recommended by Line
Ensures maximum recoveries from dues of chronic litigation-based consumers not-paying since 6 months or more
Runs a legal cover in disconnection of high profile/high value cases
Forwards cases for recovery through Land Revenue Procedure Under LRA 1967
Conducts Meetings and negotiates with consumers for "Out of Court" settlements on disputed/recoverable amounts in line with the policies laid down by KE
2 Legal Correspondence:
Analyzes and drafts comments/responses for cases at all legal forums such as EIK, Federal Ombudsmen, NEPRA, Lower and High Courts, Secretary Energy etc.
Keeps track of Legal notices and try to resolve the issues, if not then makes the case and forwards it to the Legal Department of KE
Takes regular updates from internal and external panel of Lawyers regarding the cases forwarded
Assures implementation of Orders passed by legal authorities
Files appeals/review in case of non-acceptance of decisions passed
3 Representation at Courts and Other Bodies:
Attends and assists during hearings in Federal Ombudsman, EIK, NEPRA, Civil Court and High Court or at any other legal forum on behalf of company
4 Reporting:
Maintains and updates data base of all legal cases of the cluster
Prepares periodical litigation review reports presented to the higher management; assessing potential risks and possible outcomes
Improves customer satisfaction through proper record keeping, conducting timely investigations, ensuring due follow-ups and provides feedback within stipulated time
